Court Told To Declare Ned Nwoko’s Seat Vacant For Defecting To APC

A member of the Peoples Democratic Party (PDP), Marvis Ossai, has taken legal action to remove Senator Ned Nwoko from his position in the National Assembly.

Ossai filed a suit at the Federal High Court in Abuja, asking for Nwoko’s seat to be declared vacant due to his defection from the PDP to the All Progressives Congress (APC).

The lawsuit, marked FCH/ABJ/CS/325/2025, sighted by News About Nigeria argued that Nwoko no longer has the right to represent Delta North under the PDP’s mandate.

The plaintiff is also requesting that the Independent National Electoral Commission (INEC) conduct a by-election within 60 days if the court rules in favor of the suit.

The case named Nwoko, INEC, the PDP, and the Senate as defendants.

Ossai, through his legal team, urged the court to not only remove Nwoko but also order him to refund all salaries and allowances received since January 2025.

He further sought to disqualify Nwoko from contesting in future elections until he complies with the court’s judgment.

The suit claimed that Nwoko’s defection violates the Nigerian Constitution, arguing that his continued stay in office undermines the principles guiding political party loyalty.

It also stated that the APC’s ideology is different from the PDP’s, which makes it unjust for Nwoko to hold his position after switching parties.

The plaintiff insisted that allowing Nwoko to remain in the Senate after leaving the PDP would encourage instability in the political system.

The affidavit supporting the suit stressed that the case should be treated urgently to prevent further complications.

As of now, no judge has been assigned to hear the case.
