Court Of Appeal Affirms Ndume, Lawan As Senators

The Abuja Division of the Court of Appeal on Thursday affirmed the election of Mohammed Ndume and Kaka Lawan as senators from Borno South and Central Senatorial Districts, respectively, News About Nigeria reports. 

A three-member panel chaired by Judge Biobele Georgewill found that two challenges to the legislatures were inconclusive and lacked merit.

The Independent National Electoral Commission, INEC, declared Mr Ndum and Mr Lawan the winners of the February 25 National Assembly elections.

Muhammad Kumaria and the Peoples Democratic Party (PDP) were not satisfied with the declaration and opposed Mr Lawan’s victory at the poll.

Meanwhile, Kudla Satumari and the People’s Democratic Party submitted a petition against Mr Ndume to the Electoral Commission.

The court dismissed both petitions for lack of merit.

Mr. Kumari and Mr. Satumari were not satisfied with the court’s decision and appealed against the decision of the Court of Appeals No. 1. CA/G/EP/SEN/BR/7/2023, by Mohammed Umaru Kumalia and others vs Kaka Shehu Lawan and others and Decision No. CA/G/EP/SEN/BR/04/2023 / between Kula Satumari and others Vs. INEC et al.

In the two appeals, Yusuf Ali represented Mr Lawan and APC, Johnson Usman represented INEC while Marcel Oru represented Mr Ndume.

The prosecutors asked the court to reject the objection due to lack of evidence.

In reaching its decision, the court accepted the submissions of the lawyers that the two appeals filed by the defendants were devoid of merit and did not accept the same in confirming the election of Mr Lawan and Mr Ndum, respectively.
