The appeal filed by the All Peoples Movement (APM) against Kashim Shettima, the vice presidential candidate of the All Progressives Congress (APC), has been dismissed by Justice Tsammani Haruna Tsammani, the chairman of the Presidential Election Appeal Court (PEPC).
News About Nigeria recalls that the APM is a party opposing Bola Ahmed Tinubu being declared the winner of the 2023 election.
The APM had maintained that the election act, which bars double nomination, was broken by Shettima’s selection as Tinubu’s running partner.
When Tinubu chose Shettima to be his running mate, he was a senatorial contender.
According to Justice Tsammani, the pre-election matter that called into question Shettima’s eligibility to serve as the APC presidential candidate’s running mate should have been brought before the Federal High Court.
Additionally, he claimed that the petitioner had to have sought the Federal High Court within 14 days after Shettima’s selection as the APC’s vice presidential candidate.
In addition, he said that the APM meddled excessively in the affairs of the APC. He claimed that the APM could only contest Shettima’s nomination if it could demonstrate how the nomination had damaged it.
The petition was eventually dismissed by Justice Tsammani for being without merit.

Recall that the judiciary had on Monday fixed today Wednesday, September 6 to rule on petitions brought by the Labour Party’s presidential candidate, Peter Obi and that of the Peoples Democratic Party, Atiku Abubakar against the presidency of Bola Tinubu.
