Tribunal: Court Sacks Delta PDP, APC Reps

The National Assembly Election Petition Tribunal sitting in Asaba, Delta State, has nullified the election of a two-term member of the House of Representatives on the platform of the All Progressive Congress, Francis Waive, News About Nigeria reports.

Following his removal, the tribunal therefore declared the candidate of the Peoples Democratic Party in the February 25 election, Solomon Ahwinahwi, as the winner of the polls to represent Ughelli North/Ughelli South/Udu federal constituency.

News About Nigeria also gathered that, in another judgement, the court ordered a re-run for Enwhe ward 09 of Isoko federal constituency and directed that the Certificate of Return issued to Mr Jonathan Ukohdiko of the PDP as the winner of the February 25, 2023 polls in Isoko federal constituency election should be set aside.

The candidate of the Social Democratic Party (SDP) for Isoko federal constituency, Dickson Ebegbare, prayed the tribunal to nullify the election because according to him, Ukohdiko was not duly elected by lawful votes and no election was held in the contentious ward 09.

The tribunal, therefore, nullified the election in the case of Waive who was the APC candidate due to failure to have his qualification published.

Waive, however, rejected the tribunal’s judgement, vowing to appeal it at the appellate court, insisting that the grounds for his disqualification were not known to Nigerian law.

While in the case of Ebegbare of the SDP against Ukohdiko of the PDP, the Court ordered a rerun election within a 90-day time frame but the exact date for the rerun is yet to be known.
